The basics

Liftual Terms of Use

Version 1.0 · Français

DRAFT FOR REVIEW — this is not legal advice. Text prepared for review and approval by Maxime (Noriven) before any publication, ideally also by a Québec lawyer. Passages marked [TO CONFIRM: …] are facts or choices that still need a decision. Do not publish as is.

Version: 1.0 (draft) · Working draft dated: October 10, 2026 · Effective date: [TO CONFIRM: date]

1. Who we are and what you agree to

Liftual is a service provided and operated by Noriven, a company established in Québec, Canada [TO CONFIRM: exact legal name, legal form and Québec enterprise number (NEQ)]. In these Terms, “we”, “our” and “us” refer to Noriven.

“Liftual” or “the App” means the application for iPhone, iPad and Apple Watch. “The Site” means liftual.app, including the online personal space.

By creating an account, using the App without an account or using the Site, you agree to these Terms and to our Privacy Policy, which is part of them. If you do not agree, do not use Liftual.

2. What Liftual does

Liftual is a structured training app. You create strength sessions and cardio workouts, group them into programs, place them in your week, then perform and log them on iPhone or Apple Watch. Your history, your progress and the activities imported from Apple Health are brought together in one place.

Liftual does not impose a starter program: you build your own sessions, in the App or with an AI assistant that you choose to connect.

Some features are optional: exchanging data with Apple Health, the nutrition journal, connecting an AI assistant and, when it is offered, access for a coach you invite [TO CONFIRM: is the coach space offered at launch?].

Liftual is an organization and tracking tool. It does not replace a qualified trainer or a health professional (section 4).

We may change features over time. Some may be offered as a preview [TO CONFIRM: is Liftual still in alpha or beta at launch?].

3. Age, account and no-account mode

3.1 Minimum age

You must be at least 18 years old to use Liftual [TO CONFIRM: threshold taken from Glutax; 14 is the Law 25 age of consent for a minor]. By creating an account, you confirm that you meet the age requirement. A false statement about this violates these Terms and may lead to closure of the account.

3.2 No-account mode

You can use the App without creating an account. In this mode, your sessions, programs and settings stay on your device and are not sent to our servers. Features that go through our servers, such as connecting an AI assistant, are not available.

If you uninstall the App or delete its local data, that data is lost. We cannot recover it.

3.3 Liftual account

To sync your data and connect an assistant, you create an account. It is managed by Noriven Auth, Noriven’s identity service. You can sign up with an email address and a password (confirmed by a code sent to your address), with Apple and, when it becomes available, with Google.

You agree to:

  • provide accurate information and keep it up to date;
  • protect your password and your access, and remain responsible for what happens from your account;
  • tell us without delay of any unauthorized use;
  • have only one account per person and not share it.

Your Liftual account is separate from any account you may have with other Noriven products, even with the same email address. There is no automatic link between them.

3.4 Signing in with Apple or Google

You may use the sign-in methods offered on your platform, including Apple, and Google when it becomes available. Liftual does not receive your Apple or Google password: the provider only confirms to us the information needed (identifier, email address).

You must keep access to that third-party account and comply with its terms. If you lose it, you may no longer be able to sign in to Liftual. Write to us: we will review recovery options after verifying your identity, with no guarantee of account merging or recovery. Removing a connection does not delete your Liftual account.

3.5 Suspension and closure by us

We may suspend or close your account in the event of:

  • a violation of these Terms;
  • false or misleading information;
  • fraudulent or abusive use, including an attempt to attack the service;
  • a legal obligation or a request from an authority.

Except in cases of serious violation or fraud, we notify you by email before acting and give you, where applicable, the opportunity to correct the situation.

4. Health and physical activity

4.1 No medical advice

Liftual provides no medical advice, diagnosis, treatment or personalized health advice. Programs, loads, heart rate zones, paces, energy expenditure estimates, load or recovery indicators and any other suggestion, whether from the App or from an AI assistant, are general guidelines.

4.2 Your responsibility

Physical activity carries a risk of injury. You engage in it at your own risk. In particular:

  • consult a physician or qualified professional before starting a program or significantly changing one, especially if you have a health condition, an injury, a pregnancy or take medication;
  • stop exercising if you feel pain, dizziness, unusual shortness of breath or discomfort;
  • adapt each session to your condition, level and equipment;
  • stay aware of your surroundings during outdoor activity (traffic, weather, lighting, terrain). Do not handle your phone in a way that endangers your safety or that of others.

4.3 Measurements and estimates

Heart rate, calories, distance, pace and the GPS route depend on sensors (iPhone, Apple Watch, other devices) and may be inaccurate. They are estimates, not medical measurements. Liftual is not a medical device.

4.4 Nutrition

If you turn on the nutrition journal, intake (energy, protein, carbohydrates, fat) and targets are for your personal tracking. Estimated meals are identified as such. The journal does not replace the advice of a physician or a dietitian.

4.5 Emergencies

Liftual is not an emergency service. In an emergency, call 911.

5. AI assistants (MCP connection)

5.1 An optional feature

If you ask us to, you can connect Liftual to a compatible AI assistant, such as Claude, ChatGPT or Gemini, or to any other assistant that supports MCP and OAuth sign-in. The assistant can then read, and modify if you allow it, the data in your Liftual account.

Liftual does not itself run any AI model and does not send your data to an AI provider on its own initiative. The assistant you connect is the one that retrieves it, with your authorization.

5.2 You decide

The connection is made through an authorization page from Noriven Auth. Permissions are separate by category (dashboard, strength sessions, cardio, programs and plans, nutrition, settings), each for reading and for writing. You choose what you grant.

You can remove an assistant’s access at any time in the App (Settings › Apps and devices › AI assistants). The assistant must then obtain a new authorization. Changes made by an assistant appear in the App after it syncs.

5.3 Independent services

Assistants are services independent of Liftual. ChatGPT belongs to OpenAI, Claude to Anthropic and Gemini to Google LLC. This feature alone does not create a partnership with them. Their terms and privacy policy apply to what they receive and keep of your data. We do not control that processing.

We do not guarantee compatibility with any particular assistant. Availability depends on your account, your region and each provider’s rules.

5.4 Limits

An AI assistant can make mistakes. With write permission, it can create, modify or delete programs, sessions, activities, nutrition entries and settings. Check what it proposes and what it changes before relying on it. You are responsible for the permissions you grant and for how you use an assistant. Section 4 applies in full to an assistant’s suggestions.

6. Apple Health and Apple Watch

Exchanging data with Apple Health is optional. You grant or withdraw each permission in Apple’s Health app, and in the App (Settings › Apps and devices › Apple Health) you choose whether to send your sessions to Apple Health and import authorized activities. Without permission, some features, such as importing activities done in other apps, are limited; you can still enter your data by hand.

How Liftual handles this data is described in the Privacy Policy. It is never used for advertising and never sold.

Apple Watch can record a session offline and then transmit it through the iPhone. Transmission may be delayed. Check that your session appears in your history.

Deleting your Liftual account does not delete data already in Apple Health. You manage it in the Health app.

7. Acceptable use

Use of Liftual is personal. It is prohibited to:

  • use Liftual for fraudulent or illegal activity;
  • access another person’s account or data;
  • bypass security measures or technical limits;
  • extract data from the service by automated means other than the assistant connection described in section 5;
  • overload the service, copy it, disassemble it, decompile it or reverse engineer it;
  • resell or redistribute access to Liftual.

To preserve availability and prevent abuse, temporary rate limits or other technical protections may apply. They must not be bypassed. A violation may lead to suspension or closure of the account.

8. Your content and our rights

8.1 Your data

The sessions, programs, activities, nutrition entries and settings you create remain yours. You grant us only the limited right to host, copy, process and display them to provide the service you request (syncing, display on your iPhone and Watch, assistants you authorize). We do not sell your data and we do not use it to train AI models.

8.2 Our rights

The App and the Site, including the code, design, exercise library, illustrations, anatomy diagrams and the Liftual and Noriven marks, are protected by intellectual property rights. Some media are used under third-party licences.

We grant you a limited, non-exclusive, non-transferable and revocable licence to use the App under these Terms. It ends if you violate them or when your account is closed.

8.3 Suggestions

If you send us ideas or feedback, we may use them freely, with no obligation to you.

9. Pricing

As of the date of these Terms, Liftual is offered free of charge [TO CONFIRM: pricing model at launch; there is no in-app purchase in the current code]. If we introduce paid features, the price, taxes, duration and renewal terms will be shown to you before purchase, payment will be handled by the App Store, and these Terms will be updated. We will clearly tell you of any price change before it applies to you.

10. Privacy

The handling of your personal information is described in our [Privacy Policy](/privacy), which is part of these Terms. Your optional consents (Apple Health permissions, location, connecting an assistant) are separate from your acceptance of these Terms and can be withdrawn as that policy explains.

11. Technical requirements and availability

  • Internet connection. It is required to sign in, sync, use an assistant and access the online space. A session can be recorded offline on iPhone or Apple Watch; pending changes are sent when the connection returns. Full offline operation is not guaranteed.
  • Compatibility. Current versions target iOS 18 or later and watchOS 11 or later [TO CONFIRM at App Store submission]. Available features may vary by device, region and version.
  • Language. The App is offered in French and English.
  • Updates and maintenance. We may publish updates and suspend the service for planned or unplanned maintenance. We try to notify you in advance when possible, without guaranteeing continuous availability.
  • Your copies. Editing conflicts, interruptions or errors can occur. Keep a record of the information that matters to you.

12. Limitation of liability

12.1 Nature of the service

To the extent permitted by law and subject to your mandatory rights, Liftual is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that calculations, estimates or imported data are free of errors, or that the service will be uninterrupted. Liftual is not a health professional, a certified trainer or a dietitian.

12.2 Bodily injury and serious fault

Nothing in these Terms excludes or limits our liability for bodily or moral injury, for intentional fault or gross fault, or any liability that cannot be excluded or limited by law.

12.3 Cap

Subject to the above, our total liability for damages that may lawfully be capped is limited to the amounts you paid us for Liftual in the preceding 12 months [TO CONFIRM: cap; since Liftual is free, this amount is currently zero; consider a fixed floor]. This cap does not apply where mandatory law prohibits it.

12.4 Third-party services

Apple, Google, AI assistant providers and other third-party services have their own terms, interruptions and restrictions. Their involvement does not release us from our legal security, privacy and consumer protection obligations.

12.5 Québec consumer rights

The Québec Consumer Protection Act and other mandatory laws give you rights that may override these limitations. If a provision of these Terms is contrary to them, it is replaced by the applicable legal rule, without affecting the other provisions.

Nothing in these Terms waives your right to bring or participate in a class action, or any other remedy protected by mandatory law.

12.6 Force majeure

To the extent permitted by law, an event beyond our reasonable control that meets the legal criteria for force majeure may affect performance of the service. A provider outage does not automatically qualify. We take reasonable continuity and communication measures appropriate to the circumstances.

13. Ending use and deleting your account

13.1 By you

You can stop using Liftual at any time. To delete your account, open Settings › Delete my account. Deletion takes place in three steps, in this order:

  1. your training data on our servers;
  2. your account and your connections (Noriven Auth);
  3. the App’s data on your device.

Deletion is permanent. It does not delete data in Apple Health, nor copies you exported or that a connected assistant has already received. Remove Liftual from your assistant’s connections. If you want to keep your data, ask us for an export before deleting your account (section 17). Retention details are in the Privacy Policy.

13.2 By us

We may suspend or close your account in the cases listed in section 3.5. If we end the service, we notify you at least 60 days in advance, unless impossible, and give you the opportunity to obtain your data.

13.3 Survival of clauses

The following sections survive the end of use: intellectual property (8), limitation of liability (12), privacy (10) and governing law (15).

14. Changes

14.1 New version of the Terms

When we publish a new version, the App shows a page before giving access to your account. It gives the version number, lists what changed and links to the full text. You must accept that version to keep using your account.

If you decline, you can ask us to export your data and delete your account (section 13).

14.2 Notice

For a major change (one that affects your rights, your obligations or how your information is processed), we email you before it takes effect, at least [TO CONFIRM: 30 days, as with Glutax] when possible. For a minor correction or clarification, [TO CONFIRM: 7 days]. Any new consent needed for a processing activity is requested before that processing.

14.3 Without an account

If you use the App without an account, the acceptance page is not shown. The version in force remains available on the Site and in the App, and continuing to use Liftual after a change constitutes acceptance [TO CONFIRM].

14.4 Changes to the service

We may change or remove features. We announce the removal of a major feature at least 30 days in advance when possible. Nothing removes your mandatory rights.

15. Governing law and dispute resolution

These Terms are governed by the laws of Québec and the federal laws of Canada that apply in Québec. The competent courts are determined under the rules applicable to the dispute. The choice of Québec law does not deprive you of a court or mandatory protection to which you are entitled as a consumer.

You may write to us to seek an amicable resolution; we aim to respond within 30 days. This step is optional and does not prevent you from going to court or exercising a remedy within applicable deadlines.

If a provision is found invalid, the others remain in force.

These Terms are available in French and English. In case of discrepancy, the French version prevails.

16. General provisions

  • Entire agreement. These Terms, together with the Privacy Policy, form the complete agreement between you and Noriven regarding Liftual.
  • Waiver. Not exercising a right, or delaying in doing so, is not a waiver of it.
  • Assignment. You may not assign your rights without our written consent. We may assign ours, in particular in a merger, acquisition or sale of assets, informing you in accordance with the Privacy Policy.
  • Notices. We write to the email address of your account. You write to us at the address in section 17. A notice sent by email is deemed received 24 hours after sending. Keep a valid address and also check your spam folder.
  • No partnership. These Terms create no partnership, joint venture, employment or agency between you and Noriven.

17. Contact us

For any question about these Terms, to request an export of your data or to exercise your rights:

Email: contact@liftual.app Company: Noriven, Québec, Canada [TO CONFIRM: postal address; the address on the glutax.ca Contact page is 40 rue Strasbourg, suite 1002, Candiac, Québec J5R 0B4]

We aim to respond within a reasonable time.
